Dear Mr. Baker:

This responds to your letter of August 5, 2005, requesting reconsideration of the determination by the U.S. Dept. of Education (Department), Office of Civil Rights (OCR), in the above-referenced complaint, and your subsequent correspondence dated August 26 and 29, 2005; April 8 and 27, 2006; and May 16, 2006, regarding the complaint. Your correspondence dated April 8 and 27, and May 16, 2006, were addressed to Alberto R. Gonzales, Attorney General, U.S. Dept. of Justice, and Margaret Spellings, Secretary of Education, U.S. Dept of Education. I have thoroughly reviewed your letters and the OCR case file. For the reasons set forth below, I have determined the initial determination of OCR was correct.

Background:

On May 9, 2005, OCR received your complaint alleging the St. Louis Community College (College), St. Louis, Missouri, discriminated against you and other students on the basis of sex. Specifically, you alleged the College engaged in discrimination in February 2005 by including material in its Human Services 205: Crisis Intervention (HMS 205) course that indicates husbands as opposed to wives, are the predominant perpetrators of physical violence, abuse, and aggression in relationships, and men are the predominant sexual abusers of women, other males, and children of both sexes. You alleged the information in the course materials is false and discriminatory and stated that OCR should not permit the College to retain or use such information. You alleged you complained to College officials about the information in the course materials, but the College took no action to correct the situation. You Alleged you dropped the HMS 205 course because of the information in the course materials and because the College failed to take action regarding the information being taught in the course.
